I've been hearing the name of this game for ages, it seems like. I wonder how long it took them to make it. Anyway, I just bought crayon physics, but it seems all games overheat my computer and kill it, so I may have to get this.

That's funny, because for me it feels like I saw the first trailer ages ago and now, suddenly, it has a release date and final trailer. Maybe I just haven't been checking the right sites.
That demo really impressed me! It was already a day-of-release purchase for me, but I'm all the more excited about playing the full game now. I ran into some physics flubs, but I kind of expect them sometimes with physics based games. The last puzzle was genius. Similarities to Crapyon Physics are obvious, and I'm already seeing comments to that effect. I enjoyed Crayon Physics but Max has a sense of progression and adventure that was missing from CP. "Get the ball to the star" got a little repetitive; however creative the scenarios were, I began to question my motivation toward the end. Max and the Magic Marker has much more scope for interesting scenarios.

Actually I think the blame lies with Nicalis. They've already revealed that the game failed Nintendo's submission testing at least once. It's not that it's late, it's that they've been so awful at communicating. Check their forums if you want to see a lot of once-fans who are now pretty resentful. Pixel himself must be going insane. I'll probably buy both eventually, but Cave Story will have to wait until I put more pretend money points in the Wiiware account. Nothing has been said about the delay, and that's why it's so frustrating. I've given up caring so much now. If they were both released on the same day, I'd buy Max and the Magic Marker.
I just bought it. It's great fun and worth the 1000 points you were probably saving for Cave Story. Physics flubs don't happen as much as I'd expected but the controls take a bit of getting used to (you jump with Z). There have been some interesting puzzles so far that aren't featured in the demo. I don't want to spoil anything, but I've had to draw surfboards, hamster balls, see-saws and boats for Max to use. Drawing with the Wiimote is not as natural as using a mouse, but it works pretty well.
I just read that a PC version is coming soon. I'd recommend getting that instead. Everything I said above will still apply but it's easier to draw with a mouse than a Wiimote.
It's not as bad as it sounds, but definitely not as comfortable as a mouse. It sits somewhere between drawing with a mouse and drawing with an analogue joypad. I'd agree with that review, having played it a bit more. The concept and presentation are great but the puzzles are often quite samey.
