is it legal to sell your own games via eBay with the starting price being the cost of the medium? say 10p or whatever? if the price rises then its not YOUR fault. assuming you have the non-pro version of MMF.

oh and some bastard had a CD with TOR on it, the OLD version mwhahaha. serves them right.

You can sell games with MMF standard , you just got to put the logo and stuff on it.

You know, a way to combat any people selling click games and freeware games would be to make games especially for an official Daily click cd that can pay for the server charges. Obviously we can't put our already freeware games on it so we would have to make games for it but it would be worth it.

maybe a competiton for the best game would be an incentive?

He also seems to have confused public domain with freeware. The games aren't public domain, as the authors still hold copyright or implied copyright. Unless the author specifically states it, or a certain period is past (whatever that is for software), nothing is public domain.

Still, that just proves he's an idiot, it's not actually illegal. However, the copyright statement is misleading, so it's something he could be reported for. I might do so later.

I think the "expiry date" is 50 years for software, although I could be wrong about that. Claiming that the price is for the HTML menu system and the time spent downloading and collecting is a clever way around it... though I hope he's fooling no-one.

Okay, you can't send ebay an email unless you're a member, and I can't remember my password (I very rarely use ebay). Um. If anyone would like to report the first listing for me, let me know and I'll write up the complaint. Basically, while what he's doing is legal, he's made some claims about copyright that are misleading, stating that no copyrights are held by the authors of these games. That's GOT to be illegal. Or an ebay no-no at least. Enough to get the listing removed hopefully.

The listing http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&category=11048&item=8150294100&rd=1 (item 8150294100) contains misleading statements regarding copyright. The lister appears to claim to hold copyright over the entire games compilation CD, yet I have identified several of the games from the seller's images and know that this is not the case: the contents of his CD are distributed under the freeware license and the original authors still hold copyright.
Additionally, the seller claims that "All these games are available in the public domain." This is incorrect. These games are freeware; they have not entered the public domain and will not do so unless stated by the copyright holders.
Although it is legal to sell freeware for a small duplication fee, the remarks within the listing are damaging to the rights of the software authors to the point of offensiveness, and I therefore request that the listing be removed.

Another thing to do is everyone should add a notice in their game's menu or installer or whatever saying basically the game is freeware but cannot be distributed without the author's permission. You might want to have a notice saying that you shouldn't have paid for this game. That'll put off any game swipers.
